Federal Circuit Voids $107.5M Verdict on Enablement Grounds

The Federal Circuit affirmed a ruling that Wyeth’s patents for treating drug-resistant lung cancer were invalid for lack of enablement, wiping out a $107.5 million jury verdict against AstraZeneca. The precedential decision found the specifications’ lab data and broad dosage ranges did not teach a workable patient dosing regimen.
